NOTICE OF PUBLIC HEARING

CITY OF GUADALUPE

NOTICE IS HEREBY GIVEN that the City Council of the City of Guadalupe will hold a Public Hearing at a special City Council meeting at:

6 p.m., May 18, 2021

in the City Council Chambers, 918 Obispo Street, Guadalupe, CA

The City Council will conduct a public hearing to consider introducing on first reading Ordinance No. 2021- 494 to repeal Guadalupe Municipal Code Chapter 9.21 Cannabis Regulations and replace it with Chapter 9.22 Commercial Cannabis Businesses and Amend the Zoning Code sections 18.06 Definitions, 18.16 Zoning Map and Zoning Districts, and 18.52 Design and Development Regulations.

The ordinance implements the provisions of the Medicinal and Adult Use Cannabis Regulation and Safety Act (“MAUCRSA”) and Proposition 64; imposes regulations to protect the health, safety, and welfare of the residents of the City of Guadalupe; and enforces rules and regulations consistent with state law. Chapter 9.22 is proposed to be the regulatory ordinance, comprised of two primary parts: the process for obtaining a cannabis permit, and the requirements for operating a cannabis business.  The proposed ordinance would outline and codify the process for obtaining a permit to operate a cannabis business, including the initial application procedure, permittee selection process, renewal, revocation, and transfer of a commercial cannabis permit.  The specifics of the application process, including application requirements, evaluation procedures, and application evaluation criteria would be developed and approved as part of a separate City Council resolution following the adoption of the regulatory ordinance.  Additionally, amendments to the Zoning Code are proposed to address definitions and create land use permit regulations and processing for the physical site locations when proposed by an applicant.  The Zoning Code amendments will define the specific zoning districts cannabis businesses may operate in, what type of land use permit will be required, and site design requirements.  The project is exempt from CEQA because Proposition 64 and SB94 exempt the creation of ordinances and regulations for cannabis activities under California Business and Professions Code (BPC) section 26055(h).
